Right now, we are all enjoying experimenting with AI to enhance our marketing efforts, whether it’s to help with writer’s block, inspire creativity, or present us with a new way of looking at something we’ve been staring blankly at for hours!

There are SO many different generative AI tools and so many ways to incorporate using them in our marketing and content creation processes. Here are a handful of examples...

  1. Ideation: AI tools can assist in brainstorming ideas, formulating strategies, and storyboarding. By providing a continuous stream of ideas, AI acts as a tireless assistant, helping us kickstart creative processes.
  2. Market research and competitor analysis: AI excels at analyzing large datasets to identify market trends and competitor strategies. This capability enables us to make data-informed decisions and possibly even gain a competitive edge.
  3. Task automation: By automating repetitive tasks, AI frees up time to focus on strategic and creative thinking.
  4. Content creation: AI tools like ChatGPT and Midjourney can generate content ranging from blog posts to visual designs. However, this is where the legal and ethical considerations of using AI for content creation become significant…

Legal risks of using AI for content creation

A key takeaway from the seminar that we attended with legal experts Marks & Clerk was the fact that there are several legal risks involved in using AI for content creation, including:

  • Copyright and trademark infringement: AI generates content based on existing data, which may include copyrighted material. AI tools do not check for copyright or trademark violations, posing a risk of you inadvertently using protected content. For instance, an AI-generated logo might incorporate elements from existing trademark designs. An AI-generated blog post could be a totally plagiarised version of someone else’s work.
  • Legal responsibility: ‘AI made me do it’ won’t wash. Users of AI tools are legally responsible for any infringement that occurs. Courts have established that the human user, not the AI, is accountable for the usage of AI outputs. Therefore, we must ensure that AI-generated content doesn’t infringe on intellectual property rights.
  • Ethical considerations: As marketers, we want to respect the rights and efforts of other creators. It is advisable to be transparent about the use of AI in content creation and ensure that all AI-generated content is reviewed and edited by humans to maintain quality and compliance.
  • Data privacy and terms of use: AI tools often have terms and conditions that grant them rights to the data input by users. This means that sensitive company information or client data could potentially be used to generate content for other users. For example – ever used Midjourney? In their T&Cs they say what you give them provides them with worldwide no-charge loyalty free irrevocable rights to reproduce, product derivates of, share, display, distribute... You need to think about these things with the AI tools!

So, how do you protect your brand and intellectual property?

  • Develop AI policies: Establish clear guidelines on how and when AI tools should be used within your organization. This ensures that all team members are aligned and aware of the potential risks.
  • Educate your team: Ensure that your team understands the legal and ethical implications of using AI. This involves creating a culture of responsible AI use and encouraging team members to be vigilant about compliance.
  • Choose AI tools wisely: Opt for AI tools that have partnerships with content providers, as these are more likely to have safeguards in place to minimize the risk of infringement.
  • Maintain good records: Document your AI usage and content creation processes. This documentation can be invaluable if you need to demonstrate due diligence in the future.

However, it’s essential to be aware of the legal risks of AI in marketing and the ethical challenges that accompany it.
